1. APPLICABILITY

This EULA (“End User License Agreement”) applies to the website, the products, and the intellectual property rights of Andrew Fly.

Genealogy Audio is a sub-brand of Cinematic Alpha, and all related content, including the slogan “Your Sound Legacy Tree,” is protected by copyright.
By purchasing Genealogy products, buyers acknowledge and accept that Genealogy Player may undergo updates and might not function correctly on certain architectures. Buyers agree not to claim refunds, as Genealogy Player is considered an experimental product.

2. LICENSE GRANT

The product is licensed to a single user only, allowing individual or commercial use of Cinematic Alpha® products.

Products designed for different players (e.g., Genealogy Player, Native Instruments Kontakt, or Audiomodern Soundbox) are not considered identical. Each player offers unique features, and the sound designer may adapt certain sounds for better compatibility and performance across platforms.

Cinematic Alpha may, in rare cases, offer crossgrades for products on different players. However, no crossgrade policy is in place at this time.

Sounds and samples are licensed, not sold. A single user can install the library on their computer. The samples cannot be copied or cloned into commercial products.
None of the content in the library may be used for commercial machine learning or derivative AI products.

3. RESALE

Users may not share, copy, sell, or distribute the sample library to others. Distribution in any form—including packaging in loop and sample packs, multi-samples, patches in a sampler, or any music-oriented sample playback device—is strictly forbidden. Filtering, layering, combining, or re-synthesizing the samples does not change this rule.

4. RIGHTS

Andrew Fly retains copyright and ownership of all sounds and programs included in Cinematic Alpha products. Genealogy Audio, as a sub-brand, is protected under these same rights.

5. REFUNDS

No refunds will be issued for downloaded products, as they cannot be remotely deactivated. Exceptional cases (e.g., issues with our download platform) may involve alternative resolutions, such as remote assistance or alternative download links.

6. TERMINATION

The license is terminated if the user violates any of the terms in this EULA.

7. RESPONSIBILITIES

Cinematic Alpha is not liable for:
• Incomplete payments or website downtime affecting access to products
• Losses due to improper usage or failure to back up purchased products
• Incompatibility issues with third-party programs like Native Instruments Kontakt

8. DIGITAL MUSIC RECOGNITION

Cinematic Alpha is not responsible for issues caused by Content ID or Digital Music Recognition systems, as they depend on external algorithms.

9. UNAUTHORIZED USE

Unauthorized use of Cinematic Alpha products, logos, or trademarks will result in legal action.

10. LINKS EXPIRATION

Download links may not be renewed to reduce piracy risks. Users are advised to save their products immediately after download.

11. BUSINESS REPUTATION

Cinematic Alpha will report cases of reputational damage or unauthorized use to local legal authorities.
